The Texas Register is the journal of State agency rulemaking for Texas. The rulemaking actions are codified into the Texas Administrative Code, which is maintained by the Office of the Secretary of State. Francie A. Frederick, General Counsel to the Board of Regents, reviews and certifies all U. T. System submissions to the Texas Register. To ensure compliance and to facilitate processing of submissions, the following procedures must be followed when preparing consultant contract submissions.
A U. T. System institution that plans to enter into, renew, or announce a major consulting service contract may be required to submit a notice to the Office of the Board of Regents for posting in the Texas Register. Consult Texas Government Code, Chapter 2254, "Professional and Consulting Services," and Business Procedure Memorandum (BPM), http://www.utsystem.edu/bpm/43.htm, to determine specific filing requirements.
Please also refer to the Consultant Contract Submission Checklist for preparing submissions. Requests for consultant contract submissions must include the submission (see checklist) and a statement that the appropriate Executive Vice Chancellor has approved the submission.
Consultant contract submissions should be emailed to bor@utsystem.edu with a copy to rhankins@utsystem.edu. Please provide a contact name and phone number upon submission, and the Board Office will confirm receipt. If there is a question or concern about a submission, please contact the Board Office at (512) 499-4402. The Board Office will also notify submitters by email when their submission has been forwarded to the Texas Register.
The Texas Register publishes once a week and submissions must be filed with the Secretary of State no later than noon on Wednesdays to be accepted into the next issue, which is published 11 calendar days later. Submissions must be received in the Board Office no later than Monday morning.

Choose the appropriate statute and confirm that all required elements are included in the Consultant Contract submission. Check the boxes to indicate that required elements are in the draft of the posting being submitted to the Board Office.
Publication In Texas Register Before Entering Into Major Consulting Services Contract, Texas Government Code 2254.029. Not later than the 30th day before the date it enters into a major consulting services contract, a State agency shall file with the Secretary of State for publication in the Texas Register:
- a statement that the request for consulting services is filed under the provisions of the Texas Government Code, Chapter 2254
- an invitation for consultants to provide offers of consulting services
- the name of the individual who should be contacted by a consultant that intends to make an offer
- the closing date for the receipt of offers
- the procedure by which the state agency will award the contract
- disclose in the invitation if the consulting services sought relate to services previously provided by a consultant
- disclose in the invitation if the State agency intends to award the contract for the consulting services to a consultant that previously provided the services, unless a better offer is received
Publication In Texas Register After Entering Into Major Consulting Services Contract, Texas Government Code 2254.030. Not later than the 20th day after the date of entering into a major consulting services contract, the contracting State agency shall file with the Secretary of State for publication in the Texas Register:
- a statement that the award of consulting services is filed under the provisions of the Texas Government Code, Chapter 2254
- the publication date the proposal was published in the Texas Register and the Texas Register citation of the consultant proposal request (volume) TexReg (page number)
- a description of the activities that the consultant will conduct
- the name and business address of the consultant
- the total value and the beginning and ending dates of the contract
- the dates on which documents, films, recordings, or reports that the consultant is required to present to the agency are due
Renewal; Amendment; Extension Publication, Texas Government Code 2254.031. A State agency that intends to renew a major consulting service contract shall:
- file with the Secretary of State for publication in the Texas Register the information required by the Texas Government Code Section 2254.030 not later than the 20th day after the date the contract is renewed if the renewal contract is not a major consulting services contract; or
- comply with Texas Government Code Sections 2254.028 and 2254.029 if the renewal contract is a major consulting services contract
