Background:
On
August 9, 1985, the U. T. System Board of Regents adopted a policy to
implement requirements then contained in Section 86 of Article 5 of the General Appropriations Act for 1986-87
requiring approval and availability of financial disclosure statements required
by Article 6252-9b, Section 3, Texas
Revised Civil Statutes Annotated (now Chapter 572, Texas
Government Code).
Under
the 1985 policy, the financial disclosure statements were presented, approved,
and available for public inspection through the docket process. The June 14,
1990 amendment made the financial disclosure statements available for review,
approval, and public inspection through the Executive Committee Letter process.
The
November 9, 1995 revisions are consistent with current law which does not
require Regental review or approval of these financial disclosure
statements. Those revisions transfer
review and record keeping responsibility from the U. T. Board of Regents
to the appropriate Executive Vice Chancellor and eliminate the Executive
Committee Letter process.
a. REQUIREMENT FOR FILING. On or before April 30, the Chancellor of the
U. T. System and the president of each component institution shall file
financial disclosure statements (Statement[s]) with the Texas Ethics Commission
pursuant to Chapter 572, Texas Government Code. At the time of filing, each president shall
furnish a copy of such Statement to the applicable Executive Vice Chancellor
for review.
b. The Statements shall be retained for an appropriate period as a part of the records of the office of the appropriate Executive Vice Chancellor, open to public inspection.
c. The Statement form promulgated by the Texas Ethics Commission shall be utilized.
d. SPECIAL REQUIREMENTS FOR NEW APPOINTEES. Within 45 days after assumption of duties, persons newly appointed to positions requiring the filing of Statements shall file a Statement with the Texas Ethics Commission and furnish a copy of such Statement to the appropriate Executive Vice Chancellor for review. Persons who file under this subsection and who notify the Texas Ethics Commission in writing of such filing are not required to file again under the provisions of subsection (a) above within the same calendar year.
