Purpose:

 

Policy for waiver of tuition and fees under certain conditions

Background:

 

House Bill 1907 passed by the 75th Texas Legislature, Regular Session, and codified as Texas Education Code Section 54.218, allows a governing board to waive a fee under certain conditions related to distance learning or other off-campus courses.

 

Additionally, the 75th Texas Legislature added a provision to the Texas Education Code Section 54.2041, that permits, but does not require, the governing board of an institution of higher education to exempt a Texas resident peace officer, permanently disabled in the line of duty, from the payment of tuition and required fees.

 

NOTE:  These policies have been superceded by a blanket delegation by the U. T. Board of Regents to the presidents to grant exemptions and waivers from tuition, fees, and other charges in accordance with applicable provisions of the Texas Education Code and the Regents' Rules and Regulations, Part One, Chapter VI, Section 9.

 

 

Waiver of fees for distance learning
or other off-campus courses

 

The Board delegated to the president at each component institution of The University of Texas System authority for the limited waiver of an institution's fees under the following conditions:

 

a.      A student is enrolled only in distance learning courses or other off-campus courses of the institution

 

b.      The student cannot reasonably be expected to use the activities, services, or facilities on which the fee is based, and

 

c.      The waiver of the fee will not materially impair the ability of the institution either to service any debt on which the fee is based or to offer or operate the particular activity, service, or facility supported by the fee.

The Board delegated to the presidents of The University of Texas System component institutions the authority to exempt students who are Texas resident peace officers, permanently disabled in the line of duty, from the payment of tuition and/or required fees.
