Educational Materials Agreements

These Agreements address the following issues involved in creating and using educational materials on University of Texas System campuses:

• creation
• use
• ownership
• exploitation
• distribution
• publication

Read Who Owns What first, to learn enough about ownership under Copyright Law to judge which of these contracts is best for your situation. Start with the one that best describes your circumstance, or unless your campus has a Master Agreement on file with the UT TeleCampus, try filling out our online forms to create a first draft tailored to your needs.

These are agreements between (or among) creators of works and their University:

• Faculty Ownership Agreement

  This agreement used to be referred to as our Telecourse Agreement and covers distance education materials created solely by a faculty member, either with or without significant kinds or amounts of University resources

  Contemplates sole faculty ownership of copyright pursuant to our Intellectual Property Policy (in other words, there will be no University contribution of copyrightable expression)

  Includes a faculty right to review and revise the work

• Joint Ownership Agreement

  Covers educational materials, especially multimedia materials and others that will likely involve University contribution of copyrightable expression and signifcant kinds or amounts of other resources

  Contemplates that the University will jointly own the resulting work with one or more faculty members

  Permits parties to elect which one will be responsible for marketing the work

  Includes a faculty right to review and revise the work

• Contribution to a Collective Work

  Covers circumstances where an author will contribute material to a collection of similar materials, for example, contributing a course to an online degree program or a module to an online course.

  The contributor will retain copyright ownership of the contribution, but the University will own copyright in the collection and will retain a perpetual license to use the contribution.

  Includes a faculty right to review and revise the contribution.

• Work For Hire Agreement

  Covers any contribution to a University or faculty owned copyrightable work made by someone outside the UT System (contract labor) or a contribution from someone within UT System specifically commissioned or hired to make the contribution.

These agreements are for courses for the UT TeleCampus:

• TeleCampus Funded Educational Course Materials Master Agreement

  This Master Agreement, once executed with a particular UT campus, permits faculty members at that campus to document each project for the TeleCampus on a shorter form as an Exhibit to the Master Agreement. There are 2 forms of faculty agreement under the Master Agreement: one for courses that the faculty member will own solely, and one for courses involving University contribution of copyrightable expression and signifcant kinds or amounts of other resources which generally result in joint ownership by the University and the faculty member. Both attachments are included with the Master Agreement.

• TeleCampus Funded Joint Creation and Ownership Agreement

  In the absence of a Master Agreement with the faculty member's University, this agreement should be used for courses  involving University contribution of copyrightable expression and signifcant kinds or amounts of other resources.

• TeleCampus Funded Faculty Owned Contribution to a Collective Work Agreement

  In the absence of a Master Agreement with the faculty member's University, this agreement should be used for courses that do not involve University contribution of copyrightable expression or significant kinds or amounts of other resources.

• Amendment to Educational Course Materials Agreement

This agreement is used to renew, extend or otherwise amend an existing Educational Course Agreement involving the TeleCampus.

These agreements are between the owner(s) of a work and a publisher:

• Contribution to Print Publication Agreement (UT Publishing)

  Contemplates assignment of copyright to the University in a contribution to a University Publication

• Print Publishing Agreement (UT Publishing)

  Contemplates any of several arrangements regarding transfer of copyright to a University publisher:

  • author retention of copyright with Publisher licensed merely to publish one time
  • author assignment of copyright
  • anything in between
    
    

• Contribution to Electronic Journal Agreement (UT Publishing)

  Contemplates author retention of copyright in an article or other contribution to a University electronic journal
